Terms & Conditions
The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and any or all Agreements: “Client”, “Customer”, “You”, and “Your” refers to you, the person accessing this website, contracting our services and accepting the Company’s terms and conditions. “The Company”, “Ourselves”, “We” and “Us”, refers to Big Easy Pour, LLC “Party”, “Parties”, or “Us”, refers to both the client and Big Easy Pour, LLC, or either the client or Big Easy Pour. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our service to the client in the most appropriate manner. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to the same.
Guarantees & Inclusions
Big Easy Pour guarantees that all bartenders are TABC certified and that Big Easy Pour has background checks and TABC certificates on file for every employee serving alcoholic beverages.
Your package includes cups, beverage napkins, straws, garnishes (limes, lemons & cherries), and mixers (club soda, cranberry juice, orange juice and pineapple juice – NO SOFT DRINKS) are included in all packages.
Carbonated beverages, soft drinks, sodas or “cold drinks” are not included and must be provided by the client UNLESS a beverage package is added to the service.
NOTE: Mixers are not to be used as non-alcoholic beverages. Please purchase a non-alcoholic beverage package to include any mixer that you would like as an option for your event. Bartender on site may use discretion when serving mixers as beverages when mixer choice is not included in a non-alcoholic beverage package.
Pet Policy
Big Easy Pour requires all pets be secured away from service areas at bartender arrival and pets are not allowed to be near or within the service area while bar service is commencing.
Deposits, Payments, Gratuity and Incidental Expenses
Deposit
At the time of booking a credit card and 33% of your total event price is due as a deposit and serves as a retainer to hold your date. Retainers are completely refundable within 72 hours of payment IF your event is less than a month away. If your event is a last-minute booking determined as an event happening within 24 to 120 hours of booking or either the same day or on the immediate weekend your retainer is non-refundable once a bartender has agreed to work your event.
Payments, Payment Schedule and Advance Payments
Payment can be made through the invoice that is sent to you at the time of booking. CashApp, VenMo, Square or Zelle are also valid payment options but must be approved before payment is sent. Visa & Mastercard are accepted through your personalized Square invoice. Once you receive an invoice you have the option to fill out the CC Auth form. Your card will be charged upon receipt by Big Easy Pour LLC via Square. Your credit card is kept on file either with the CC Auth form or through Square. If you have not had your consultation or are waiting for the full price of your event you may pay a $75 retainer to hold your date in lieu of the 33% deposit. A credit card is needed on file.
Once your initial retainer has been paid you should expect payments to continue as follows:
50% of your remining total is due 2 weeks before your event.
The remaining balance is due 48 hours before your event.
Advance payments are welcomed. You may pay as you wish through any of the accepted ways to pay.
Liquor must be paid for in advance if Big Easy Pour will be delivering your liquor order. You can pay for your order through your selected vendor or as detailed on your invoice.
Gratuity
Gratuity is optional for all events. Tips jars will be displayed as part of the bartender’s setup. If Clients request for tip jars to not be displayed a 33% gratuity will be added to the invoice. This will be discussed during your consultation and included or excluded in your service package.
Incidental Expenses
Incidental expenses are defined as fees and expenses charged to Big Easy Pour or its employees upon arriving to your event. These can include but are not limited to parking fees, entry fees, mileage on errands for supplies not provided by the client and additional hours or time. Incidental expenses will be charged back to the client on the credit card on file at our earliest convenience. An additional incidental expenses invoice will be sent to the email address on file if no other discussions have been had involving this additional client fee.
Cancellations, Refunds & Customer Complaints
Cancellations
Cancellations must be made in writing via email to info@bigeasypour.com or via text. The following cancellation periods apply.
72 Hours Prior to the Event: 20% of total invoice will be charged to the credit card on file
Within 72 Hours of the Event: 50% of the total invoice will be charged to the credit card on file
If the client is not present or if the venue is unavailable at the time of the scheduled service to accept delivery of services, a $20 trip fee will be charged to the credit card on file in addition to the forfeit of the full balance of contracted services charged the day before.
Unless a cancellation notice is provided verbally or in writing by a member of Big Easy Pour, we will arrive on the client’s event date, at the service address and provide the requested services.
Cancellations can be granted with no penalty in the occurrence of any circumstance beyond the control of either party – such as venue cancellations due to the COVID pandemic, acts of God, war, government regulations, disaster, strike, or civil disorder– to the extent that such circumstance makes it illegal or impossible to provide services.
Big Easy Pour can terminate any service agreement without liability if Big Easy Pour cannot provide operable equipment or bartenders. Big Easy Pour must give client a referral for an equal to or greater than service provider at that time. Any retainer fee or advancement payments will be returned the client if Big easy Pour terminates the service agreement.
Refunds
Upon termination of written or verbal contracts of service within the stated guidelines above, any fees collected from the client in advance less retainer fee will be refunded immediately in the same form that payment was rendered.
Retainers are completely refundable within 72 hours of payment IF your event is less than a month away. If your event is a last-minute booking determined as an event happening between 24 to 120 hours either the same day or on the immediate weekend your retainer is non-refundable once a bartender has agreed to work your event.
Customer Complaints
Client agrees to discuss and resolve any conflicts or issues with Big Easy Pour’s Founder or Managers and is prohibited from posting complaints or negative comments on public websites including but not limited to Instagram, Facebook, Yelp, Google, Wedding Wire and The Knot.
Exclusions, Waivers & Compliance with Laws
Exclusions
1) Excludes all representations and warranties relating to this website and its contents or which is or may be provided by any affiliates or any other third party, including in relation to any inaccuracies or omissions in this website and/or our company literature; and
2) Excludes all liability for damages arising out of or in connection with your use of our services. This includes, without limitation, direct loss, loss of business or profits, damage to household, business or personal injury caused by use of our equipment, or any other direct or indirect, consequential and incidental damages.
3) Big Easy Pour excludes liability for death or personal injury caused by its negligence.
Liability Waivers
Big Easy Pour does not endorse the over consumption of alcoholic beverages. The client assumes all liability for themselves and their party guests if any form of negligence arises from the consumption of alcohol. Should the customer and/or his or her party guest(s) become ill and/or injured while under the influence of alcohol, the customer and/or his or her guest(s) assume all responsibility for any financial expenses including but not limited to medical bills, vehicle repairs, and all other damaged personal property.
Big Easy Pour employees will not serve alcoholic beverages to individuals under the age of 21. Big Easy Pour employees assumes the right to ask for age verification from any guest that appears under aged and can refuse service to any guest found under age unless indicated by TABC laws in the State of Texas.
The client is responsible for monitoring the consumption of alcoholic beverages by guests. Big Easy Pour assumes the right to refuse any guest that appears intoxicated
Should the client and/or party guest(s) become ill due to consumption of the prepared mixture, the client assumes all liability.
The customer waives all legal rights to pursue any form of legal action against Big Easy Pour and its staff for the reasons stated above and against all claims, losses or damages to persons or property, governmental charges or fines and costs (including attorney’s fees).
Compliance with Local, State & Federal Law
This Agreement is subject to all appropriate federal, state, and local laws, including health and safety codes, alcoholic beverage control laws in place and enforced by the Texas Alcohol Beverage Commission, disability laws, federal anti-terrorism laws and regulations. Big Easy Pour and the client agree to cooperate with each other to ensure compliance with such laws.
Copyright and other relevant intellectual property rights exist on all text relating to Big Easy Pour services and the full content of this website. The company’s logo is a registered trademark of Big Easy Pour in the United States and other states.
